These Terms & Conditions ("Terms") govern your use of the Avenwood Cabins website at avenwoodcabins.com (the "Site") and all services provided by Aquino Vacation Rentals LLC, doing business as Avenwood Cabins ("we," "us," or "our"), including cabin reservations, on-site amenities, and communications. By accessing the Site or making a reservation, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Eligibility

You must be at least 21 years of age to make a reservation or serve as the primary guest. The person making the reservation must be present during the entire stay. By making a reservation, you represent that you meet these requirements and that all information you provide is accurate and complete.

2. Reservations & Payment

All reservations are processed through our booking partner, Cloudbeds. A valid credit or debit card is required to confirm your reservation. Full payment is due at the time of booking unless otherwise specified.

• Rates displayed on the Site are starting rates and may vary based on season, dates, cabin selection, and availability.
• All prices are in U.S. dollars (USD) and are subject to applicable taxes and fees.
• We reserve the right to modify pricing at any time. Changes will not affect confirmed reservations.
• A confirmed reservation constitutes a binding agreement between you and Avenwood Cabins.

3. Cancellation & Refund Policy

• 14+ days before check-in: Full refund minus a $50 cancellation fee.
• Less than 14 days before check-in: Non-refundable, unless the cabin is re-rented for the same period, in which case a refund minus a $100 cancellation fee will be issued.
• No-shows and early departures: Non-refundable.
• Same-day cancellation: Reservations cancelled within 24 hours of booking (and at least 14 days before check-in) may be eligible for a full refund.

All cancellations must be made through Cloudbeds or by contacting us directly. Refunds are processed to the original payment method within 5–10 business days.

4. Gift Cards

Avenwood Cabins gift cards are sold and fulfilled through Gift Up!, a third-party gift card platform. By purchasing a gift card, you also agree to Gift Up!'s terms of service.

• Validity: Gift cards are valid for 10 years from the date of purchase.
• Activation: Gift cards are valid immediately after purchase and may be redeemed any day of the week.
• Delivery: Gift cards are delivered electronically via email to the recipient address provided at checkout.
• Redemption: Gift cards may be applied toward the cost of any cabin reservation at Avenwood Cabins. They cannot be used for add-on services purchased separately.
• Non-refundable: Gift card purchases are final and non-refundable.
• No cash value: Gift cards cannot be exchanged for cash, check, or credit, except where required by law.
• Partial use: If a gift card does not cover the full cost of a reservation, the remaining balance must be paid with another payment method. Any unused balance remains on the gift card for future use.
• Lost or stolen: Avenwood Cabins is not responsible for lost, stolen, or unauthorized use of gift cards. Treat your gift card code like cash.

5. Check-In & Check-Out

• Check-in: 4:00 PM EST
• Check-out: 10:00 AM EST
• Early check-in (2:00 PM): Available for $50, subject to availability.
• Late check-out (12:00 PM): Available for $50, subject to availability.

All cabins use keyless entry. Access instructions will be sent via email prior to your arrival. Failure to check out by the designated time may result in additional charges.

6. Property Rules

By staying at Avenwood Cabins, you agree to the following rules:

• No Smoking: All cabins are strictly non-smoking (including e-cigarettes and vaping). A $250 cleaning fee will be charged for any evidence of smoking inside a cabin.
• Quiet Hours: 10:00 PM to 8:00 AM. Excessive noise may result in eviction without refund.
• Maximum Occupancy: Each cabin has a posted maximum occupancy. Exceeding this limit may result in immediate eviction without refund.
• No Events or Parties: Events, parties, and gatherings exceeding the cabin's maximum occupancy are strictly prohibited without prior written approval.
• Firewood: Only use firewood provided on-site or purchased locally. Do not bring firewood from outside the region to prevent invasive pests.
• Trash: All trash must be placed in the designated bins before departure. A cleaning fee may apply for excessive mess.
• Illegal Activity: Any illegal activity on the premises will result in immediate eviction, forfeiture of all fees, and reporting to local authorities.

7. Pet Policy

All cabins are pet-friendly. The following terms apply:

• A non-refundable flat rate of $50 covers all pets for the entire stay.
• Pets must be supervised at all times and are not permitted on furniture or beds.
• Active pets must be crated when you are not in the cabin.
• A $150 fine will be charged for any damage caused by pets.
• Please clean up after your pets (sweep fur, pick up waste). Lint rollers available upon request.
• Guests are fully responsible for any property damage, injury, or disturbance caused by their pets.

8. Damage & Liability

Guests are responsible for any damage to the cabin, its contents, or surrounding property during their stay. A damage assessment will be conducted after check-out. Charges for damage beyond normal wear and tear will be applied to the credit card on file.

You agree to report any damage, maintenance issues, or safety concerns to Avenwood Cabins promptly during your stay.

9. Assumption of Risk

Avenwood Cabins is located in a natural, wooded environment. By staying at our property, you acknowledge and accept the inherent risks associated with outdoor recreation and rural settings, including but not limited to:

• Use of hot tubs, including risks of drowning, burns, slips, and falls.
• Use of fire pits and charcoal grills, including burn risks and fire hazards.
• Navigating outdoor terrain, including uneven ground, steps, decks, and trails.
• Exposure to wildlife, insects, and natural hazards.
• Driving on gravel roads and driveways.
• Use of wood-burning fireplaces.

You voluntarily assume all risks associated with your stay, including risks to yourself, your guests, your pets, and your personal property.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Avenwood Cabins, its owners, operators, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site or our services, personal injury, property damage, or loss during your stay, theft or damage to personal belongings, interruption of services or amenities, or actions of third-party service providers.

In no event shall our total liability exceed the amount you paid for your reservation.

11. Indemnification

You agree to indemnify, defend, and hold harmless Avenwood Cabins, its owners, operators, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or our services, your stay at any Avenwood Cabins property, your violation of these Terms or any applicable law, or any damage caused by you, your guests, or your pets.

12. Website Use

You agree to use the Site only for lawful purposes. You shall not attempt to gain unauthorized access to any part of the Site, use automated tools to scrape or access the Site without written permission, or transmit any malicious code or harmful content.

13. Intellectual Property

All content on the Site, including text, photographs, graphics, logos, icons, and software, is the property of Avenwood Cabins or its content suppliers and is protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or publicly display any content from the Site without our prior written consent.

14. Electronic Communications

By using the Site, making a reservation, or providing your contact information, you consent to receive electronic communications from us, including booking confirmations, check-in instructions, service-related notices, and promotional offers (if opted in). You agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

15. SMS/Text Message Terms

If you opt in to receive text messages from Avenwood Cabins, you consent to receive recurring automated text messages at the number you provided. Message and data rates may apply. Message frequency varies. Consent is not a condition of purchase. Reply STOP to opt out. Reply HELP for assistance. We will not share your phone number with third parties for marketing purposes.

16. Force Majeure

Avenwood Cabins shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, wildfires, flooding, pandemics, government actions, utility failures, or acts of terrorism. In such cases, we will make commercially reasonable efforts to reschedule your stay or provide credit for a future visit.

17. Dispute Resolution

1. Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us at support@avenwoodcabins.com. We will make good-faith efforts to resolve the matter within 30 days.
2. Mediation: If informal resolution is unsuccessful, the parties agree to attempt mediation before a mutually agreed-upon mediator in Perry County, Ohio.
3. Litigation: If mediation is unsuccessful, any legal action shall be brought exclusively in the state or federal courts located in Perry County, Ohio, or the Southern District of Ohio.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Avenwood Cabins regarding your use of the Site and our services.

21. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site or our services after any changes constitutes your acceptance of the revised Terms.
